Terms & Conditions
These terms govern your enrolment in and use of the educational programmes offered by Kemilau Bestari. Please read them in full before registering. By completing an enrolment, you confirm that you have read, understood, and accepted these terms.

1. Definitions
In these Terms and Conditions, the following words carry the meanings set out below:
- "Kemilau Bestari", "we", "us", "our" — Kemilau Bestari, a financial education provider operating from 124 Jalan Burma, 10350 George Town, Penang, Malaysia.
- "Programme" — any course or structured engagement offered by Kemilau Bestari, including The Writing Desk: A Money Review, Considered Investing for the Second Half, and the Estate and Family Provision Programme.
- "Participant", "you", "your" — any individual who has registered for or enrolled in a Programme.
- "Materials" — all written content, worksheets, reading lists, session recordings, and facilitated exercises provided as part of a Programme.
- "Agreement" — these Terms and Conditions, together with any enrolment confirmation issued to you.
2. Acceptance of Terms
By completing your registration and making payment, you confirm that:
- You are at least 18 years of age.
- You have the legal capacity to enter into this Agreement.
- You have read and accept these Terms in full.
If you are registering on behalf of another person, you confirm that you are authorised to accept these Terms on their behalf and that they are aware of and agree to the same.
3. Service Description
Kemilau Bestari offers small-group and single-track financial education programmes for adults, conducted in person at our George Town, Penang premises unless otherwise notified. Programme details, including duration, class size, and session schedule, are provided at the time of registration.
We reserve the right to adjust session content, reading materials, or the sequence of topics within a programme to better serve the learning group, provided that the overall scope and learning objectives are maintained.
All programmes are conducted in English unless otherwise stated. Participation is currently available to residents and individuals located in Malaysia.
4. Enrolment and Participation
Enrolment is confirmed only upon receipt of full payment and an enrolment confirmation from Kemilau Bestari. Places are allocated in order of payment receipt. We reserve the right to decline any registration at our discretion, with a full refund issued if we do so before a programme commences.
Participants are expected to attend all scheduled sessions. While we understand that circumstances may prevent full attendance, consistent absence without notice may affect your ability to complete the programme meaningfully. We do not issue certificates of completion.
Group size limits apply to certain programmes to preserve the quality of facilitation. We will not exceed these limits once confirmed.
5. Participant Responsibilities
As a participant, you agree to:
- Attend sessions punctually and engage respectfully with fellow participants and facilitators.
- Complete written exercises and reflections as part of the learning process, to the best of your ability.
- Keep the personal financial details shared by other participants strictly confidential.
- Refrain from recording sessions — audio, video, or otherwise — unless written consent is obtained from Kemilau Bestari and all session participants.
- Not use the programme context to solicit business, sell financial products, or promote commercial services to other participants.
Kemilau Bestari may remove a participant from a programme for conduct that disrupts the learning environment or breaches these responsibilities. In such cases, no refund will be issued.
6. Intellectual Property
All Materials provided as part of a Programme remain the intellectual property of Kemilau Bestari. You are granted a personal, non-transferable licence to use these Materials for your own learning purposes only.
You may not reproduce, distribute, publish, translate, or create derivative works from our Materials without our prior written consent. This includes sharing digital copies or uploading Materials to any platform.
Any personal financial documents or written reflections you produce as part of a Programme remain your own property. We will not retain, reproduce, or share them without your explicit consent.
7. Payment Terms and Refunds
Programme fees are as published at the time of your registration. All fees are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes where stated.
Full payment is required to secure your place. We accept payment by bank transfer and such other methods as may be specified in your enrolment confirmation.
Our refund policy is as follows:
- Cancellation more than 14 days before the programme start date: full refund less an administrative fee of RM 50.
- Cancellation 8 to 14 days before the programme start date: 50% refund.
- Cancellation fewer than 7 days before the programme start date, or after commencement: no refund.
If Kemilau Bestari cancels a programme before it commences, a full refund will be issued. If a programme is suspended midway due to circumstances attributable to Kemilau Bestari, a proportionate refund will be considered at our reasonable discretion.
Participants are not entitled to transfer their place to another individual without our written agreement.
8. Programme Conduct and Educational Nature
Our programmes are structured as educational experiences. Facilitators and guest advisors (including any notary advisor engaged for the Estate and Family Provision Programme) provide information and context; they do not offer personal financial advice, investment recommendations, or legal advice specific to your circumstances.
Nothing covered in our programmes constitutes a recommendation to buy, sell, or hold any financial product or to take any particular legal or financial action. Participants are encouraged to seek appropriate professional advice before making significant financial decisions.
9. Disclaimers
Our programmes are provided in good faith and to the best of our facilitators' knowledge. However, we make no warranty — expressed or implied — as to the accuracy, completeness, or suitability of the information provided for any particular individual's circumstances.
Financial conditions, laws, and regulations change. Content that was accurate at the time of preparation may not reflect the most current position. Participants should verify information independently and seek current professional advice where needed.
We do not warrant that attendance in our programmes will produce any particular financial outcome for any participant.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Kemilau Bestari's total liability to any participant in connection with a Programme — whether in contract, tort, or otherwise — shall not exceed the fee paid by that participant for the relevant Programme.
We shall not be liable for any indirect, consequential, or economic loss arising from participation in or reliance upon our programmes, including any financial decisions made on the basis of programme content.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.
11. Termination
Either party may withdraw from a programme before it commences, subject to the refund terms in Section 7.
We may remove a participant from an ongoing programme if, in our reasonable judgement, their conduct poses a risk to the experience of other participants or breaches these Terms. In such cases, the refund terms in Section 7 apply.
Sections 5 (Participant Responsibilities), 6 (Intellectual Property), 9 (Disclaimers), and 10 (Limitation of Liability) shall survive termination of this Agreement.
12. Dispute Resolution
These Terms are governed by the laws of Malaysia. Any dispute arising from or relating to these Terms or any programme shall first be referred to informal resolution by contacting us at [email protected].
If a dispute cannot be resolved informally within 30 days of written notice, either party may refer the matter to the courts of Penang, Malaysia, which shall have non-exclusive jurisdiction.
For consumer disputes, participants may also refer complaints to the relevant Malaysian consumer protection bodies.
13. General Provisions
Entire Agreement. These Terms, together with your enrolment confirmation, constitute the entire agreement between you and Kemilau Bestari with respect to the relevant Programme.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
Waiver. A failure to enforce any provision of these Terms on one occasion shall not constitute a waiver of that provision on any other occasion.
Assignment. Kemilau Bestari may assign its rights under these Terms without restriction. You may not assign your rights or obligations without our written consent.
Notices. Notices to Kemilau Bestari should be sent in writing to the address below or by email to [email protected]. We will send notices to the email address provided during registration.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our programmes or applicable law. Updated terms will be posted on this page with a revised effective date. Your continued enrolment after any update constitutes acceptance of the revised terms.
We will not alter the terms applicable to a programme you have already paid for and are attending, without notifying you in advance.
